Agency for the Management of Sequestrated and Confiscated Assets

The Ministry of Justice, within the framework of its commitments for the fulfillment of activities in the implementation of Law No. 03/L-141, for the Administration of Seized or Confiscated Assets, has established the Agency for the Administration of Seized and Confiscated Assets, which is an executive agency within the Ministry of Justice.

After identifying important and concrete issues in order to increase effectiveness and efficiency in the administration of seized and confiscated property, the amendment of Law No. 03/L-141 on the Administration of Seized or Confiscated Property was supplemented with the Law No. 05/L-049 for the Administration of Seized and Confiscated Property (Official Gazette of the Republic of Kosovo / No. 12/14 April 2016, Prishtina), which defines Agency as the central body of the state administration within the Ministry of Justice.

Our mission

The Agency for the Administration of Seized and Confiscated Assets has its mission the cooperation with the justice bodies, in order to fight organized crime and corruption in the Republic of Kosovo, performing its functions in order to provide profitable and professional administration of wealth and develop these functions with integrity and transparency. The main objective of the Agency is to become a professional center in the administration of seized and confiscated property.

Composition of the Agency

The organizational structure of the Agency for the Administration of Seized and Confiscated Assets is determined by Regulation QRK-NR.31/2013 on the Internal Organization of the Ministry of Justice, and as follows: 1. Office of the General Director; 2. Directorates; a. Directorate of Acceptance, Preservation of Value and Sale of Seized or Confiscated Property with relevant sectors; b. The Directorate for Legal Normative Work and Administration with the relevant sectors.

Functions of the Agency

Within the scope of the rights and duties provided by law, the Agency performs the following functions: Administers seized and confiscated property used for, or benefited from, criminal offenses, including terrorism property, with the exception of property confiscated for realization and collection of tax obligations;

•Executes the court’s order for the temporary measure for property insurance, according to the legislation in force;
•Executes the final judgment of the court, according to the legislation, can sell the items by pouring the income collected from the sale into the budget of Kosovo or handing over the assets for use by the Government;
• Makes an assessment of the value of the seized and confiscated property, as well as determines the way of preserving this property;
• Keeps the evidence for the property it administers and for the court decisions in which it was decided on the seized and confiscated property;
• Determines the way of preserving the value of the property under administration;
•Participates in providing international legal assistance for all cases involving seized and confiscated property, administering the seized or confiscated property based on the request made by another state;
•Enables the sale of seized and confiscated property, according to the decision of the competent court;
• Administers data related to seized and confiscated property in a centralized computer system;
•Provides advice to the Prosecutor’s Office, the Court and other institutions on the specific nature of the process of administration of seized and confiscated property, in order to provide assistance in planning possible seizures or confiscations;
• Sign Memorandums of Cooperation with partner bodies and relevant institutions to agree on relationships and responsibilities, as well as to increase performance, in accordance with the provisions of this law;
